1. Applicability

1.1. These terms apply to all Privify services provided by 1st Soft Limited ("we", "us", "our"), a company registered in England and Wales.

1.2. By creating an account and using Privify you agree to these terms in full. If you do not agree, you must not use the service.

2. Definitions

2.1. "Acceptable Use Policy" means the acceptable use provisions set out in clause 7 of these terms.

2.2. "Cancelling" an order means asking us not to give effect to an order you have placed before we have made the service available to you. Once a number has been provisioned, you must instead terminate the service.

2.3. "Restricting" the service means making some parts of it unavailable, for example where we have been unable to contact you regarding a breach of these terms.

2.4. "Suspending" the service means stopping it from working while keeping it in a state from which it can be resumed. Suspension does not affect your obligations under this agreement and does not terminate it.

2.5. "Terminating" the service means we stop supplying it completely and bring this agreement to an end. You are no longer liable for further ongoing charges but must still pay any outstanding amounts. Your number will be released and may be reallocated to another customer.

3. The Service

3.1. The features available to you depend on your subscription plan. The following services are available across all plans:

  • Private email aliases that forward incoming messages to your real inbox
  • An identity monitor that checks whether your email address appears in known data breaches

3.2. The following services are available on the Plus and Premium plans only:

  • A private UK mobile number
  • SMS forwarding to email
  • Voicemail recording delivered by email
  • Message history

3.3. Voicemail transcription is available on the Premium plan only.

3.4. Number porting is available on the Premium plan only.

3.5. The frequency of identity monitor checks varies by plan: weekly on the Starter plan, and daily on Plus and Premium plans.

3.6. Priority support is available on the Premium plan only.

3.7. Where a UK mobile number is included in your plan, numbers are allocated from our available pool. You do not own the number — it is licensed to you for the duration of your active subscription. Numbers may not be ported away from Privify except where the Premium number porting service applies.

3.8. Number provisioning is a manual process. We will use reasonable efforts to complete provisioning within 24 hours of payment. Any timescale we communicate is an estimate.

4. Duration

4.1. This agreement lasts until either you or we terminate it in accordance with these terms.

4.2. Minimum term. Plus and Premium subscriptions are subject to a minimum term of three (3) consecutive calendar months from the date your subscription commences. You may cancel at any time, but your subscription will remain active until the end of the minimum term and monthly fees continue to apply for that period.

4.3. The Starter (Free) plan has no minimum term. You may cancel at any time.

4.4. After the minimum term, your subscription continues on a rolling monthly basis until cancelled in accordance with clause 10.

5. Service Access, Suspension, and Maintenance

5.1. While we will use reasonable efforts to maintain and operate the services, we make no guarantee that they will always be available or fault-free. The service depends on third-party infrastructure including network operators and cloud providers.

5.2. We may restrict or suspend all or part of the service if, in our reasonable opinion, you fail to comply with your obligations under this agreement, or if we consider it necessary to:

  • stop or mitigate any security incident, threat, or vulnerability affecting our network or services;
  • deal with behaviour that amounts to misuse of the service or breach of our Acceptable Use Policy; or
  • comply with a legal obligation.

5.3. We will endeavour to provide advance notice of planned maintenance where this may cause service interruption.

6. Your Obligations

6.1. You must:

  • comply with our reasonable instructions and our Acceptable Use Policy;
  • provide accurate and complete information when registering and updating your account;
  • keep your account credentials secure and notify us immediately at support@privify.co.uk if you believe your account has been compromised;
  • be at least 18 years of age.

7. Acceptable Use Policy

7.1. You must not use Privify to:

  • send or receive messages in connection with any illegal activity;
  • harass, threaten, or harm any individual;
  • commit fraud or impersonate any person or organisation;
  • receive messages related to spam, phishing, or scam operations;
  • circumvent legal identity verification requirements; or
  • violate any applicable law or regulation.

7.2. We reserve the right to suspend or terminate your account immediately and without notice if we reasonably believe you are in breach of this clause.

8. Payments and Invoicing

8.1. Privify is offered on the following plans:

  • Starter£1.99 per month, with a 7-day free trial on sign-up;
  • Plus£6.99 per month, subject to a 3-month minimum term (see clause 4.2); and
  • Premium£10.99 per month, subject to a 3-month minimum term (see clause 4.2).

8.1a. The 7-day free trial applies to the Starter plan only. A valid payment method is required to start the trial. No charge is made during the trial period. After 7 days, the £1.99 monthly fee is charged automatically unless you cancel before the trial expires. The Plus and Premium plans have no trial period and billing begins immediately on sign-up.

8.2. There are no setup fees. Monthly fees are billed in advance on the same date each month.

8.3. All fees are inclusive of VAT where applicable. Payments are processed securely by Stripe. We do not store your card details.

8.4. Payment is due at the start of each billing period. If we do not receive payment in full by the due date, we may restrict or suspend the service.

8.5. If we do not receive payment in full within 30 days of the due date, we may terminate this agreement. We will not be liable for any losses arising from such restriction, suspension, or termination.

8.6. Bills are provided by email and via your account. We do not provide printed bills.

9. Cancellation

9.1. This clause applies to consumers (individuals acting for personal use).

9.2. You have a statutory right to cancel within 14 days of the date of purchase (cooling-off period). If you wish to cancel during this period, contact us at support@privify.co.uk.

9.3. By using the service during the 14-day cooling-off period, you expressly request that we begin the service immediately and acknowledge that your right to a full refund may be reduced proportionately to reflect the service provided up to the point of cancellation. For plans that include a UK mobile number, this includes any number provisioning that has commenced.

9.4. The 14-day cooling-off period applies to your first subscription only. It does not apply to renewals or plan upgrades.

9.5. If we are unable to provision a UK mobile number within a reasonable time (where your plan includes one), you will receive a full refund of all amounts paid.

9.6. You may cancel the Starter plan at any time during the 7-day free trial without charge. Cancellation during the trial takes effect immediately and no payment will be taken.

10. Termination

10.1. You may cancel your subscription at any time via the Billing section of your account or by contacting us at support@privify.co.uk.

10.2. For Plus and Premium subscriptions, cancellation takes effect at the end of the minimum term (clause 4.2) if you are still within it, or at the end of your current billing period thereafter. You retain access until cancellation takes effect. No refunds are issued for unused portions of any billing period.

10.3. For the Starter plan, cancellation takes effect at the end of your current billing period. No further charges are taken after cancellation.

10.3. We may terminate this agreement immediately by notifying you if:

  • you commit a material breach of your obligations under this agreement;
  • we reasonably suspect that you cannot or are unwilling to pay your invoices; or
  • continued provision would require us to breach any law or legal obligation.

10.4. We may terminate this agreement at any time for any reason by giving you reasonable notice. In such a case, we will refund any prepaid fees for the unused portion of your current billing period.

10.5. Upon termination, your number will be released and may be reallocated. All messages, voicemails, and account data will be deleted within 30 days.

10.6. Termination does not affect any accrued rights or liabilities of either party.

11. Email Aliases

11.1. Email aliases are tied to your account and are deactivated upon cancellation or termination of your subscription.

11.2. Monthly forwarding limits apply per plan. Messages that exceed the plan limit are dropped silently and are not delivered or stored.

11.3. Aliases must not be used in breach of the Acceptable Use Policy.

12. Identity Monitor

12.1. The identity monitor is provided as a supplementary feature and does not constitute a security guarantee. The frequency of checks varies by plan: the Starter plan includes weekly checks; Plus and Premium plans include daily checks.

12.2. We cannot guarantee that all data breaches are detected or that alerts are delivered in real time. Coverage depends on the third-party breach data sources we use.

12.3. Breach alerts are informational only. You remain solely responsible for the security of your accounts and credentials.

12.4. We accept no liability for any loss arising from a data breach or from reliance on an identity monitor alert.

12.5. To provide breach alerts, your account email address is shared with third-party breach data sources. By enabling or using the identity monitor feature, you consent to your email address being used for this purpose.

13. Data Retention

13.1. SMS messages and voicemails are stored for 90 days from the date of receipt, after which they are automatically deleted.

13.2. Voicemail audio files are stored in Cloudflare R2 object storage and accessible via time-limited secure links.

13.3. You may delete individual messages and voicemails at any time via your account.

13.4. You may permanently delete your account and all associated data via the Settings section of your account. Account deletion is immediate and irreversible.

14. Data Protection

14.1. We process your personal data in accordance with UK GDPR and the Data Protection Act 2018. References to a "Regulation" in this clause are to UK GDPR as incorporated into English law.

14.2. We act as a Data Controller in respect of your account information and message data. We use your data solely to provide the service and send transactional communications related to your account.

14.3. We will never sell your personal data to third parties.

14.4. We will notify you without undue delay if we become aware of a personal data breach that is likely to result in a risk to your rights and freedoms.

14.5. You are responsible for ensuring that your use of the service complies with your own obligations under data protection law.

15. Complaints

15.1. If you wish to make a complaint, please contact us at support@privify.co.uk. We will acknowledge your complaint within 2 business days and aim to resolve it within 14 days.

15.2. If we are unable to resolve your complaint, you may refer it to an alternative dispute resolution (ADR) scheme. Details will be provided at that stage.

16. Limitation of Liability

16.1. Our total liability to you in respect of all breaches of this agreement is limited to the lesser of:

  • a pro-rata sum of the price you paid for the service for the period in which we were in breach; and
  • the amount you paid for the service in the month in which you notified us of the breach, excluding any one-time or non-recurring charges.

16.2. We are not liable for any indirect, consequential, or special losses, including but not limited to loss of profits, missed messages, or loss of data.

16.3. Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

17. Varying This Agreement

17.1. We will give you at least one month's notice by email if we increase the price of the monthly subscription. If you do not accept the change, you may cancel your subscription before the new price takes effect.

17.2. We may update these terms from time to time. We will notify you by email at least 14 days before any material changes take effect. Continued use of the service after that date constitutes acceptance of the updated terms.

17.3. We will post a notification in your account or by email if we make material changes to the functionality of the service or withdraw the service.

18. Governing Law

18.1. These terms are governed by the laws of England and Wales. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
